Terms of Use

Terms and Conditions

These Terms and Conditions (hereinafter referred to as the “Terms”) set forth the conditions governing the use of the “JAPAN EXPRESS” online store (hereinafter referred to as the “Online Store”) provided on this website by JAPAN EXPRESS PORTAL (hereinafter referred to as the “Company”).

All users who browse or use the Online Store or purchase products through the Online Store, whether registered members or non-members (hereinafter referred to as “Users”), shall use the Online Store in accordance with these Terms.

Article 1 (Application)

  1. By placing an order for products through the Online Store, the User shall be deemed to have agreed to these Terms.

  2. In addition to these Terms, the Company may establish rules of use, shopping guides, return and refund policies, shipping policies, product-specific notices, and other rules or policies relating to the Online Store (hereinafter collectively referred to as “Individual Provisions”). Regardless of their title or form, such Individual Provisions shall constitute an integral part of these Terms.

  3. In the event of any inconsistency between these Terms and any Individual Provisions, the Individual Provisions shall prevail unless otherwise expressly provided therein.

Article 2 (User Registration)

  1. To register for use of the Online Store, an applicant shall agree to these Terms, submit a registration application in the manner prescribed by the Company, and complete registration upon the Company notifying the applicant of its approval.

  2. The Company may refuse to approve an application for registration if it reasonably determines that any of the following applies. Except where disclosure is required by applicable law, the Company shall not be obligated to disclose the reason for such refusal:

(1) The applicant has provided false information in connection with the registration application;

(2) The application is submitted by a person who has previously violated these Terms; or

(3) The Company otherwise reasonably determines that approving the registration would be inappropriate.

Article 3 (Management of User ID and Password)

  1. Users shall properly manage their User IDs and passwords for the Online Store at their own responsibility.

  2. Users may not transfer, lend, or share their User IDs or passwords with any third party under any circumstances.

  3. If a login is made using a combination of User ID and password that matches the registered information, the Company may, unless there are reasonable grounds to believe otherwise, regard such use as having been made by the registered User.

  4. To the extent permitted by applicable law, the Company shall not be liable for any loss or damage arising from inadequate management of a User ID or password, errors in use, unauthorized use by a third party, or similar circumstances, except where such loss or damage results from the Company’s willful misconduct or gross negligence or where the Company is otherwise liable under applicable law.

Article 4 (Formation of Sales Contract, Delivery, Title, and Risk of Loss)

  1. When a User places an order through the Online Store, such order shall constitute an offer to purchase the relevant product. Any automated order acknowledgment sent by the Company merely confirms receipt of the order and does not constitute acceptance. A sales contract for the relevant product shall be formed when the Company separately notifies the User that the order has been accepted or when the Company notifies the User that the product has been shipped.

  2. The Company may refuse to accept all or part of an order, or may terminate or cancel a sales contract after it has been formed, if any of the following applies:

(1) The User violates these Terms;

(2) The delivery address or other order information contains false information, errors, or omissions;

(3) Payment of the purchase price or any other payment obligation is not successfully completed;

(4) The Company reasonably suspects fraudulent or unauthorized use of a credit card or other payment method;

(5) It is discovered that a person under the age of 18 placed the order without obtaining any parental or guardian consent required by applicable law;

(6) The product is out of stock and no restocking date has been determined;

(7) Before shipment, the product is damaged, defective, or otherwise becomes unsuitable for sale and no replacement product is available;

(8) The product cannot be supplied because it has been discontinued, withdrawn from sale, or for any other reason;

(9) The Company reasonably determines that shipment or delivery of the product is difficult or impossible due to laws or regulations, import or export restrictions, governmental measures, customs procedures, restrictions imposed by delivery carriers, or other circumstances in the destination country or region;

(10) There is an obvious error in the displayed product price, shipping charge, or other amount due to a system malfunction, data-entry error, or similar cause; or

(11) The Company otherwise reasonably determines that accepting the order would be inappropriate for legal or other reasonable grounds.

  1. If the Company refuses an order or terminates or cancels a sales contract pursuant to the preceding paragraph and has already received payment, the Company shall refund the relevant amount within a reasonable period. However, where the Company has actually incurred costs or suffered losses due to reasons attributable to the User, the Company may deduct such costs or losses from the refund to the extent permitted by applicable law.

  2. Title to the product shall pass from the Company to the User when the User has paid in full the purchase price and all other amounts due and the Company has delivered the product to the shipping carrier, unless otherwise required by applicable law.

  3. Unless otherwise provided by applicable law, the risk of loss, destruction, or damage to products during transit shall pass to the User when the product is delivered to the delivery address designated by the User. If the User independently selects or arranges a shipping carrier instead of using a shipping method offered by the Company, the risk associated with subsequent transportation shall pass to the User when the Company delivers the product to such carrier.

  4. Where delivery records maintained by the shipping carrier or other reasonable records confirm that delivery has been completed to the address, recipient, parcel locker, or other location designated or approved by the User, such time shall be deemed the time of completed delivery, unless this is contrary to applicable law.

  5. Unless otherwise expressly indicated on the product page, checkout page, or elsewhere by the Company, all customs duties, value-added taxes, import taxes, customs clearance fees, and other taxes, governmental charges, or costs arising in connection with the importation of products shall be borne by the User.

  6. The Company will make reasonable efforts to prepare documents required for shipment; however, the Company does not guarantee customs clearance, import approval, or successful final delivery by customs authorities or other governmental agencies in the destination country or region.

  7. If any import permit, qualification, notification, registration, or other procedure is individually required of the User in the destination country or region with respect to a purchased product, the User shall be responsible for confirming and completing such requirements. However, nothing in this paragraph shall exempt the Company from any obligations imposed on it as a seller under applicable law.

  8. If a product cannot be delivered and must be returned, stored, redelivered, disposed of, or otherwise handled due to reasons attributable to the User, including an incorrect address or other delivery information, prolonged absence, refusal to accept delivery, failure to pay customs duties or other required charges, or refusal or failure to submit documents requested by customs authorities or the delivery carrier, the Company may, to the extent permitted by applicable law, charge the User for, or deduct from any refund, the reasonable actual costs incurred by the Company, including shipping charges, return shipping charges, customs duties, taxes, storage charges, redelivery charges, and disposal costs.

  9. If delivery is delayed or becomes impossible due to natural disasters, war, riots, terrorism, infectious disease outbreaks, strikes, serious disruptions to transportation systems, customs procedures, governmental actions, changes in import or export restrictions, or other circumstances beyond the Company’s reasonable control, the Company shall not be liable, to the extent permitted by applicable law, for such delay or inability to deliver where the circumstances are not attributable to the Company. However, this provision shall not affect any right of cancellation, refund, or other remedy available to the User under applicable law.

  10. Orders cannot be cancelled for the User’s convenience after shipment. If the product conforms to the order, returns or exchanges for the User’s convenience will not be accepted unless expressly approved by the Company.

  11. If, upon delivery, the User identifies damage occurring during shipment, missing contents, delivery of an incorrect product, or any other issue that would ordinarily be discoverable at the time of delivery, the User shall contact the Company within seven (7) days after receipt of the product through the Online Store’s inquiry form or by another method designated by the Company.

  12. In the circumstances described in the preceding paragraph, the User shall, to the extent reasonably possible, retain the product, outer packaging, packing materials, shipping label, and other relevant materials until the Company’s investigation and response have been completed. If reasonably requested by the Company, the User shall provide photographs, videos, or other information showing the condition of the product, packaging, and other relevant matters.

  13. If the Company approves a return or exchange, the User shall return the product in accordance with the method designated by the Company within fifteen (15) days from the date of receipt of the product, or by such other deadline as may be separately specified by the Company.

  14. If a product is returned without prior notice to and approval from the Company, the Company may be unable to accept the return or issue a refund, to the extent permitted by applicable law.

  15. The time limits set forth in the preceding paragraphs are not intended to unfairly restrict any rights granted to Users under applicable law in relation to latent defects that are difficult to discover through ordinary inspection, products whose type or quality does not conform to the contract, or other similar circumstances.

  16. If the Company is responsible for loss or damage during shipment, delivery of an incorrect product, or any other issue, or if the Company is required to provide a remedy under applicable law, the Company shall take reasonable action, including reshipment, replacement, refund, or another appropriate remedy, depending on the condition of the product, stock availability, other relevant circumstances, and applicable law.

  17. Matters concerning payment methods, shipping methods, order cancellations, returns, exchanges, refunds, and other transactions through the Online Store that are not provided for in these Terms shall be governed by the Shopping Guide, Return and Refund Policy, Shipping Policy, and other Individual Provisions separately displayed by the Company.

  18. Notwithstanding the provisions of this Article, if mandatory consumer protection laws or other mandatory provisions applicable in the User’s country of residence, the destination country, or otherwise to the relevant transaction differ from this Article, such mandatory provisions shall prevail.

Article 4-2 (Product Use and Safety Precautions)

(5) Wear and tear or deterioration resulting from ordinary use or aging;

(6) Modification, disassembly, repair, or any other alteration of the product by the User or a third party; or

(7) Any other circumstances not attributable to the Company.

The preceding paragraph shall not exclude or limit the Company’s liability where such liability cannot be excluded or limited under applicable law, including liability arising from product defects, the Company’s willful misconduct or gross negligence, or the Company’s breach of contractual obligations.

  2. If any accident, injury, health issue, or other abnormal condition occurs as a result of the use, consumption, or other utilization of a product, the User shall, as necessary, immediately discontinue such use or consumption and seek appropriate medical attention or take other appropriate measures.
